I am writing as a Nassau County resident of [your town/village] to express my serious concerns about the recent NCPD enforcement policy banning Class 2 e-bikes and all e-scooters from county roads and property, which took effect in early March 2026.
I understand the county's interest in public safety, and I share those concerns. However, I believe this ban, as currently implemented, is overly broad and causes real harm to residents like me. I have several specific concerns I would like to bring to your attention:
1. The legal basis appears questionable. The NCPD has cited Nassau County Miscellaneous Law Title 61 and New York Vehicle & Traffic Law Article 34 to justify this ban. However, Title 61 was enacted in 2006 to address ATV use following a tragic accident—it does not mention e-bikes at all. Applying it to e-bikes and scooters appears to stretch the law well beyond its original intent, and may conflict with New York State's own 2020 legislation that established the e-bike classification system and expressly legalized Class 2 e-bikes statewide.
2. The ban eliminates all legal places to ride. By prohibiting e-bikes from roads, bike lanes, sidewalks, and public property simultaneously, Nassau County has left riders with no lawful place to operate their vehicles—even Class 2 bikes that travel no faster than 20 mph and were purchased in compliance with state law.
3. The economic impact falls hardest on working residents. Many Nassau County residents—including [delivery workers / service employees / those without cars / individuals with disabilities]—depend on e-bikes as an affordable way to reach LIRR stations, access employment, or simply get around a county with limited public transit options. This ban effectively penalizes residents who cannot afford a car.
4. Residents made good-faith purchases relying on state law. New York State law expressly permits Class 2 e-bikes. Residents spent hundreds or thousands of dollars on these vehicles in compliance with that law. An abrupt county-level ban with no grace period or transition plan is deeply unfair to those individuals.
I am not asking the county to ignore legitimate safety concerns. I support reasonable regulation—such as [helmet requirements / age restrictions / speed enforcement / designated lanes]. What I am asking is that the county:
Review the legal authority underlying this ban and ensure it is consistent with New York State law;
Engage the community in a transparent process before enacting restrictions of this magnitude;
Consider targeted solutions that address specific safety concerns without eliminating e-bikes as a transportation option entirely; and
Provide a clear and fair path forward for residents who purchased e-bikes legally and rely on them daily.
